JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Atri P.S. Case No. 178 of 2016 instituted for the offence under Section-395 of the Indian Penal Code.

It is submitted that the person from whose possession, looted truck is alleged to have been recovered, namely Khalid Naem has already been granted privilege of bail by a coordinate bench of this court vide order dated 10-01-2017 passed in Cr. Misc. No. 52166 of 2016. This petitioner is alleged to be sitting on the Bolero which was used for committing the dacoity. The petitioner is not named in the FIR and after arrest of the petitioner, his confessional statement was recorded.

According to first information report, dacoity was

Patna High Court Cr.Misc. No.12940 of 2017 (3) dt.18-04-2017 2/2 committed by unknown persons.

In such circumstance, the prayer for bail is allowed and it is ordered that the petitioner named above, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Atri P.S. Case No. 178 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Gaya subject to condition that both the bailors should be close relatives of the petitioner.
