JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 22-06-2016 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. This is the second attempt of the petitioner for bail in connection with Shahpur P.S. Case No. 171 of 2013 as earlier such prayer was rejected by order dated 24.07.2014 in Cr. Misc. No. 18627 of 2014.
Pursuant to a report called for from the Court below, the same has been submitted by the Additional District and Sessions Judge Vth, Danapur dated 30.04.2016 in which it has been stated that the matter is pending for defence to finally produce its witnesses and
Patna High Court Cr.Misc. No.10990 of 2015 dt.22-06-2016 2/2 due to non-cooperation by the defence, the matter still pending. It has further been stated that if the defence cooperates, trial can be concluded within one and a half months.
Learned counsel for the informant submits that final arguments are being made in the trial and, thus, the same is likely to be concluded.
In view of the aforesaid, the Court is not inclined to consider the case for grant of bail to the petitioner. Accordingly, the same stands dismissed.
However, the Court below shall ensure that the case is disposed off within two months positively. If the defence refuses to cooperate, the Court may proceed in accordance with law to ensure that judgment is passed within the time fixed by the Court. Registry shall communicate the order to the Court below through Fax also latest by tomorrow.
