The petitioner seeks bail in connection with Jurawanpur P.S. Case No. 46 of 2020 registered for the offences punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 19.09.2021, charge-sheet has been submitted in the case and is a person with clean antecedent and the informant alleges that his sister was married to Ajay Kumar and the accused persons including the petitioner killed her for non-fulfillment of dowry demand of gold chain and Bullet motorcycle on 23.05.2020.

The learned counsel submits that the petitioner has been falsely implicated in the present case, the informant is not

No.2359 of 2022(2) dt.25-05-2022 2/2 an eye witness to the occurrence and is the elder brother-in-law of the deceased and the husband of the deceased is in custody and co-accused Ranvijay Rai and Dinesh Rai have been granted bail by order dated 25.06.2021 in Cr. Misc. No. 8621 of 2021 and co-accused Ram Ekbal Rai and Phuljhari Devi have been granted anticipatory bail by order dated 06.07.2021 in Cr. Misc. No. 21533 of 2021.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.09.2021, is a person with clean antecedent, chargesheet has been submitted in the case and the husband is in custody and co-accused have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jurawanpur P.S. Case No. 46 of 2020.
