1. Heard the parties.
2. Petitioner seeks regular bail in connection with Dinara (Bhanas) P.S. Case No. 217 of 2024 dated 12.05.2024 registered under Section 8(c), 20(b)(ii)(b), 22(b) of the N.D.P.S. Act.
3. As per the first information report on 12.05.2024 in the evening Police got the information that petitioner has kept Ganja at his door for the purpose of sale, proceeded towards the place of occurrence and arrested the son of the petitioner. Upon search of the lounge (dalan), 04 kg 31 gm Ganja has been recovered.
4. Learned counsel for the petitioner submits that the dalan from where Ganja has been recovered does not belong to the petitioner and after partition the same has gone in the share of his brother. The partition had taken place on 14.09.2020 and the
Patna High Court CR. MISC. No.426 of 2025(3) dt.05-03-2025 2/3 respective parties (co-sharers) have applied for mutation of the properties in their name. The petitioner's son was arrested from the spot and has been granted regular bail by the district court itself. The seizure list prepared by the police does not disclose the place from where Ganja has been recovered. The petitioner is in custody since 24.11.2024 and charge sheet has already been submitted on 20.01.2025.

Regard being had to the submissions made by the parties, taking into consideration the fact that small quantity of Ganja has been recovered, the petitioner is in custody since 24.11.2024, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner.
6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Rohtas at Sasaram in connection with Dinara (Bhanas) P.S. Case No. 217 of 2024 with the following condition:- (i) that the petitioner shall not repeat the same offence in future (ii) that the petitioner shall remain present on
