1. Heard the parties.

2. It is submitted by learned counsel for the appellant that all the defects pointed out by the office have been removed and the instant appeal is filed against the judgement of acquittal passed under Section 302 of the IPC but in view of report of the office the appeal is required to be converted into a Cr. Appeal (D.B.).

3. In view of aforesaid submissions, learned counsel for the appellant seeks permission to convert this appeal into a Cr. Appeal (D.B.).

4. Permission is accorded.

5. Let this appeal be converted into Cr. Appeal (D.B.) and thereafter the appeal be placed under appropriate heading before an appropriate Bench.
