Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends her arrest for the offences alleged under Sections 467, 468, 406, 420/34 and 120(B) of the Indian Penal Code, registered in connection with Chhatauni P.S.Case No. 107 of 2020.

As per allegation, the husband of the petitioner, who was Branch Manager of Pakridayal Cooperative Bank, had withdrawn money deposited by the farmers for their Kisan Credit Accounts and transferred in the bank account of his brother Rupesh Kumar and his wife, the present petitioner. The learned counsel for the petitioner has submitted that the entire allegation is on Mukesh Kumar Sinha and on

Patna High Court CR. MISC. No.12145 of 2021(10) dt.02-08-2022 2/2 similar allegation his brother Rupesh Kumar has been granted anticipatory bail. He has submitted further that the petitioner is a lady and has no criminal antecedent.

Considering the above facts and circumstances and also considering the fact that co-accused Rupesh Kumar has been granted anticipatory bail, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Chhatauni P.S.Case No. 107 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
