Petitioner seeks bail in a case registered for the offence punishable under Section 366 of the Indian Penal Code. Wife of the informant fled away along with her child with this petitioner.

Submission is that since the allegation is that wife had voluntarily gone along with the petitioner, no offence has been committed by the petitioner. Petitioner has got no criminal antecedent. He is in custody since 05.06.2018. Investigation of the case is complete.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in

Patna High Court CR. MISC. No.4345 of 2019(3) dt.18-04-2019 2/2 connection with S.Tr. No. 83 of 2018 arising out of Sheikhpura Police Station Case No. 155 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
