JUSTICE PARTHA SARTHY ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Bhargama P.S. Case no. 120 of 2020 registered under sections 18, 20, 22 and 29 of the N.D.P.S. Act.

As per allegation in the F.I.R., 550 grams of ganja was recovered from the motorcycle being driven by the petitioner and the said motorcycle did not contain registration number. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. No incriminating article has been recovered from his possession. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 11 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bhargama P.S. Case no. 120 of 2020 (corresponding to Special Case No. 8 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge-cum-Special Judge, N.D.P.S., Araria.
