JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 387 of the Indian Penal Code.

The allegation against the petitioner is that he demanded Rangdari from the informant from mobile no. 8228856125.

It is submitted on behalf of the petitioner that the petitioner is in custody since 3.2. 2016. The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. No substantive evidence has come in course of investigation to suggest the implication of the petitioner in the present case. The petitioner has been made accused mere on suspicion and dirty village politics. The petitioner is not named in

Patna High Court Cr.Misc. No.24336 of 2016 (4) dt.18-08-2016 2/2 the FIR. During investigation it has come that Pawan Devi is the holder of mobile no. 8228856125 and the petitioner was using mobile no. 7301163899.

On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Dhaka, East Champaran in connection with Ghorasahan P.S.Case No. 27 of 2016.
