2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 17.520 liters of Nepali Saufi wine has been recovered from the house of petitioner.

4. It is submitted on behalf of petitioner that alleged recovery has been effected from the house, which is in joint possession of the family members. Petitioner lives out of Bihar for his livelihood and he has got no concern with the alleged recovery. No incriminating article has been recovered from his possession. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Exclusive Excise Court, Sitamarhi in connection with Choraut P.S. Case No. 149 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
