The petitioner is languishing in custody since 28.12.2015 in connection with Hawai Adda P.S. Case No. 183 of 2015 for the offences instituted under Sections 392 and 411 of the IPC. The prosecution story, in brief, is that on the alleged date of occurrence, two persons on the point of pistol forcibly took away the Bolero vehicle of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.12.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner has got no criminal antecedent. He is not named in the
Patna High Court Cr.Misc. No.25146 of 2016 (6) dt.16-09-2016 2/2 F.I.R. His name has come in the confessional statement of coaccused. He has not been put on T.I. Parade to ascertain his implication in the present case. The other co-accused have been granted bail by this Court vide Cr. Misc. Nos. 24841 of 2016 and 35953 of 2016.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J. M. Ist Class, Patna, in connection with Hawai Adda P.S. Case No. 183 of 2015. U.K./- (Sudhir Singh, J) U T
