JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Case No. 332-C2 of 2018 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case there is seizure of 111 liter of liquor. He submits that the seizure list was not prepared in accordance with the mandatory provisions of Section 100 Cr.P.C. the petitioner was the casual driver and was not aware of the fact that the liquor was kept inside the vehicle. He is in custody since 14.12.2018.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail

Patna High Court Cr.Misc. No.3755 of 2019(2) dt.25-01-2019 2/2 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Jamui, in connection with Case No. 332-C2 of 2018.
