2. The present appeal has been filed by the petitioner against the judgment and decree dated 31.05.1975 passed in Partition Suit No. 177/1969 / 276/1974 by the learned 1st Additional Sub-ordinate Judge, Bettiah, West Champaran.

3. Mr. Pradeep Kumar, learned counsel appearing on behalf of the petitioner seeks to withdraw the present appeal on the ground that in course of time, respective parties don't have any further grievance to claim their right in terms of the

Patna High Court FA No.378 of 1975(54) dt.10-02-2023 2/2 judgment and decree dated 31.05.1975 as by lapse to time, parties have also mutually agreed with respect to the shares and disputed property which are the subject matter of the present First Appeal.

4. Mr. Ganpati Trivedi, learned counsel appearing on behalf of the respondents has no objection.
