The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 307, 188, 283, 290, 435, 379 and 511 of the Indian Penal Code.

The prosecution case, in short, is that on account of a road accident, when the police reached, a mob assembled there and started protest against the police personnel. There is no allegation of tampering with witnesses by the petitioner. The petitioner has falsely been implicated in the present case. No one is said to have been injured in course of occurrence. Patna High Court Cr.Misc. No.3981 of 2019(2) dt.25-01-2019 2/2 general and omnibus allegation levelled against the petitioner. Altogether 40 persons are named in the F.I.R along with 160 unknown persons.

Learned counsel for the State opposed the prayer for anticipatory bail on the ground that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Narpatganj Police Station Case No. 397 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
