JUSTICE MADHURESH PRASAD ORAL ORDER 12-02-2021 Upon instructions Mr. Lalit Kishore, learned Senior Counsel informs this Court that pursuant to the query yesterday, the Bihar Public Service Commission has agreed to allow the petitioner's participation in the re-examination being conducted on 14.02.2021 for the 66th Combined Competitive BPSC Examination.

Learned Senior Counsel submits that without admitting to the allegations made by the petitioner and in view of the fact that the petitioner is visually impaired, he shall be extended the facility of a scribe and extra time, as per the guidelines of the State of Bihar, in this regard, issued by the General Administration Department dated 12.10.2017.

The learned counsel appearing for the petitioner submits that the petitioner would be participating in the Examination.

The learned Senior Counsel submits that since concession has been given in view of the fact that a reexamination is already scheduled on 14.02.2021, the matter should not be treated as a precedent.

This Court would observe that having regard to the reexamination already fixed and in view of the unique situation the concession has been granted, there is no adjudication or decision on merits of the rival submissions. Therefore this order may not be treated as a precedent.

The writ application stands disposed of.
