Patna High Court CWJC No.512 of 2020(5) dt.21-06-2022 2/3 LPA No.167 of 2016 (Avinash Kumar Chakerworty & Ors. Vs. The State of Bihar & Ors.) has wrongly been mentioned as LPA No.162 of 2016 in the representation dated 18.09.2019, due to typographical error.

After some arguments, the petitioners' counsel submits that the claim of the petitioners is still pending before the District Magistrate, Bhagalpur. As per Annexure A to the supplementary affidavit filed on behalf of the petitioners, the application is dated 18.09.2019 and places reliance on the decisions of this Court also. The petitioners' claim in the application is for grant of scale of Rs.4,000--6,000 from the date of their appointment, which was made in between the year 2001 to 2004.

Since the application is pending consideration before the District Magistrate, parties are in agreement that the Court is not called upon to decide the issue for the present. The application is thus disposed of with a direction to the District Magistrate, Bhagalpur to take a final decision on the petitioners' claim and pass a reasoned and speaking order within a period of eight weeks from the date of receipt/production of a copy of this order. Should any dues be found payable to the petitioners, the same would also be required to be paid within
