The petitioner seeks bail in connection with Sultanganj P.S. Case No. 317 of 2018 registered under Sections 279, 379, 411, 428, 429 of the Indian Penal Code, Sections 3/4 of Bihar Cattle Preservation and Protection Act and Section 11(1)/D/E/F/30(1) of Animal Cruelty (Protection) Act. Petitioner is said to be driver of the pick-up van and unloading the cattle being transported on the said vehicle he was escaping, but was apprehended by the police on interception.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no
Patna High Court Cr.Misc. No.4473 of 2019(2) dt.30-01-2019 2/2 concern with the aforesaid occurrence. He has been falsely implicated in this case. He happens to be driver of the pick-up van and the cattle were transported by the petitioner at the instruction of the owner of the vehicle purchased from Parwalpur (Nalanda Hat) vide certain invoices. Moreover, petitioner has no concern with the aforesaid cattle. He has no criminal antecedent and has been languishing in custody since 16.11.2018. Similarly situated several co-accused have been enlarged on anticipatory and regular bail by different coordinate Benches of this Court. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Patna City in connection with Sultanganj P.S. Case No. 317 of 2018.
