Learned counsel for the petitioner is directed to submit the original petition along with attested affidavits and also remove the defects pointed out by the Registry within two weeks from today.

Learned counsel for the petitioner submits that the petitioner has approached this Court earlier for seeking direction to the respondents to inspect the institute and grant recognition for D.El. Ed. Learned counsel submits that the petitioner's prayer was granted however it was left open for the petitioner to apply afresh for grant of recognition before the appropriate body

Patna High Court CWJC No.455 of 2022(2) dt.24-03-2022 2/3 in accordance with law if legally permissible. Learned counsel submits that the respondents are not opening the portal and therefore he is not able to apply afresh.

Counsel appearing for the respondents submits that recognition is not being awarded after 2019, and therefore, the portal is not being opened for the said purpose. Learned counsel submits that his application was earlier rejected and a fresh application ought to be accepted.

I have considered the submission. This court finds that the petitioner approached respondents after unexplained delay of a period of two years. That apart, the order impugned was passed on 14.12.2020 by this court and present petition has been filed in the year 2022 again almost after one and half years and the petitioner is seeking direction for allowing them to apply although no application is being accepted by the respondents for recognition as on today.

In view of the statement made at par by the counsel who appears for the respondents, no direction as prayed for can be passed solely for the petitioner alone. His case for consideration of application for recognition cannot be considered alone. No special circumstances are in his favour. In view thereof, the writ petition is misconceived and

Patna High Court CWJC No.455 of 2022(2) dt.24-03-2022 3/3 accordingly dismissed. If, as and when, the portal applications are invited by the respondents, petitioner would be entitled to apply.

The petition is accordingly dismissed.
