Petitioner seeks bail in a case registered for the offence punishable under Sections 406, 409, 420, 467, 468, 471, 472 & 34 of the Indian Penal Code.

Informant who is District Welfare Officer, Sitamarhi inspected the registers of Nazarat with the help of other officials and found several irregularities in the register. She also found that Nazir-cum-Stipend In-charge has misappropriated and withdrew huge amount of scholarship in connivance and conspiracy with the Manager and employee of Axix Bank, Sitamarhi who have opened the accounts in false and fake names.

Petitioner is not named in the F.I.R. but during the

Patna High Court CR. MISC. No.3609 of 2019(7) dt.26-03-2019 2/2 course of investigation, name of the petitioner has surfaced as one of the forged account holders and he in conspiracy with other accused persons, got huge amount transferred in his account and the accounts of his family members. Para 67 of the case diary shows that petitioner has confessed his complicity in the alleged incident. Para 78 of the case diary shows that the money was transferred in the account of the petitioner and his family members. Paragraphs nos.72 and 86, the S.D.P.O. and the S.P., Sitamarhi found the case true against the petitioner and his family members.

Considering the facts and circumstances of the case and nature of allegation and huge misappropriation and defalcation of public money and in investigation direct involvement of petitioner is found, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, Trial Court is directed to expedite and conclude the Trial within one year from the date of receipt/production of a copy of the order passed by this Court. (S. Kumar, J) Sanjay/- U T
