Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A, 26(i)(ii) and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 16-11-2024. It is further submitted that similarly situated co-accused, Ajit Sarkar and Sapn Mandal had approached this court seeking regular bail by filing Cr. Misc No. 58472/2021 and the same came to be allowed by an order dated 8-3-2022. It is also submitted that charge sheet has been submitted. 4.
Learned counsel for the petitioner at the cost of
Patna High Court CR. MISC. No.8727 of 2025(2) dt.14-02-2025 2/2 repetition submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the police with a view to save the real culprit. 5.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lakhisarai (Kabaiya) P.S. Case No. 146 of 2021.

One of the bailors of the petitioner shall be his father, Arun Mahto.

However, if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial court shall forthwith cancel his bail bonds after recording reasons. (Satyavrat Verma, J) SUMIT/- U T
