JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-05-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 1793 of 2018 registered for offence punishable under sections 498A and 406 of the Indian Penal Code. As per allegation, the marriage of the daughter of the complainant was solemnized with the petitioner in the year 2017. She went to her matrimonial house in Delhi, but there she was maltreated by her husband and in-laws. It has been averred in the complaint petition that belongings of the daughter of the complainant were also not returned and due to atrocities inflicted,

For exploring the possibility of amicable solution of the dispute, the matter was referred to the Mediation and Conciliation Centre, Patna High Court, vide order dated 03.02.2022. The report dated 29.04.2022 received from the Mediation Centre has been annexed at flag 'A', which shows that the matter could not be resolved, as opposite party no. 2 did not appear before the Mediation Centre.

It appears that due to non-appearance of opposite party no. 3 and opposite party no. 2, the process of mediation could not be resolved.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj in connection with Complaint Case No. 1793 of 2018, subject to condition as laid down under section 438(2) Cr. P.C.
