Patna High Court CWJC No.4629 of 2021(2) dt.21-12-2021 2/3 21-12-2021 The petitioner has prayed for issuance of a writ in the nature of mandamus to direct the Dakshin Bihar Gramin Bank to comply and act according to work order issued vide InterOffice letter dated 15th November, 2016 (Annexure-1) as also the lease deed dated 13.02.2017 signed by both parties which is at Annexure-3. According to him, the entire building is complete and ready for occupation but there is inordinate delay by the Bank in shifting into the same.

Faced with the situation, learned counsel appearing for the Bank submits that they are ready to shift immediately and also comply with the work order issued vide Inter-Office letter dated 15th November, 2016 (Annexure-1) and lease deed dated 13.02.2017 (Annexure-3). His apprehension is only that the moment steps are taken to shift into the building, there are mass protest by the people. Learned counsel prays that a direction be issued to seek assistance from the District Magistrate in case such a situation arises.

In view of assurance given by the counsel for the Bank, no further adjudication is necessary. Petition is hereby disposed off.

We make it clear that in case there is any protest at the time of shifting, the District Magistrate shall be at liberty to
