The petitioner is languishing in custody since 01.05.2016 in a case registered for the offences punishable under sections 20/22 of the NDPS Act.
From the shop of the petitioner 200 gram of ganja was recovered.
It is submitted by learned counsel for the petitioner that the recovery is of small quantity. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Mr. J. N. Thakur, learned APP for the State does not dispute the quantum of recovery.
Considering the quantum of recovery, let the above
Patna High Court Cr.Misc. No.24562 of 2016 (4) dt.26-07-2016 2/2 named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur, in connection with Gopalpur P.S. Case No.99/2016, arising out of G.R. No.421/2016.
