JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 11-05-2018 The present writ petition has been filed for quashing the order contained in memo no. 899-2 dated 12.05.2009 issued by the Sub Divisional Officer, Saharsa, by which the petitioner's shop under PDS bearing Licence No. 101/2008 has been suspended.
2. After some arguments learned counsel for the petitioner Mr. Aditya Prakash Sahay seeks permission to withdraw the writ petition with liberty to approach the forum of appeal against the impugned order.
3. In view of the aforesaid prayer, permission is accorded and the writ petition is permitted to be withdrawn and dismissed as such with the liberty aforesaid.
4. It is made clear that in case such an appeal is filed, the
Patna High Court CWJC No.7743 of 2018 dt.11-05-2018 concerned authority would have regard to the present proceeding, which is pending before this Court, while considering any issue relating to condonation of delay, if applicable.
