The petitioners seek bail in a case registered for offences punishable under sections 341, 323, 325, 307/34 of the Indian Penal Code.

It is submitted that there is allegation against the accused including the petitioners, to have assaulted the informant and his relatives. There was occurrence of assault between both the parties and petitioner No. 2 also lodged a case for the same occurrence against the informant and his relative as Dumaria P. S. Case No. 58 of 2014 for the offence, punishable under Sections 307 and other allied Sections of the Indian Penal

Patna High Court Cr.Misc. No.4819 of 2015 (2) dt.05-02-2015 2/2 Code. Most of the injuries are simple in nature. Only one injury is grievous, which is on knee of Jogendra Yadav. The petitioners have no criminal antecedents.

Considering the facts and circumstances, the above named petitioners, Ram Briccha Yadav and Binek Yadav are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Dumaria P.S.Case No. 57/2014 with following conditions :- I) One of the bailors will be the close relative of the petitioners.

II) The petitioners will not indulge in similar or in any other offence.

III) The petitioners will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
