The petitioner seeks bail in Pipra P.S. Case No. 88/2010 registered for the offence under Section 302, 394 and other sections of the Indian Penal Code.
Petitioner is not named in the FIR. It is submitted that firstly the police spy disclosed the name of the petitioner in para 14 of the case diary. Thereafter, three witnesses in para 56 and onwards disclosed that the petitioner was seen moving around the place of occurrence. Petitioner has got no criminal antecedent and there is no eye-witness.
Considering the facts aforesaid and the fact that the FIR is against unknown and nobody has seen the occurrence, petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.6306 of 2015 (4) dt.30-03-2015 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S. Case No. 88/2010.
