JUSTICE AMARESH KUMAR LAL ORAL ORDER 05-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under sections 341, 323, 313, 406/34 of the Indian Penal Code.
The allegation against the petitioner is to have assaulted the informant on her stomach, when she tried to save her Devar, which caused miscarriage of three months pregnancy. Learned counsel for the petitioner submits that there is land dispute between both the parties and the petitioner has been manifestly implicated in the case. However, after investigation, charge sheet has already been submitted.
Considering the facts and circumstances, the petitioner Sripati Rai is directed to be released on bail on furnishing bail
Patna High Court Cr.Misc. No.4831 of 2015 (2) dt.05-02-2015 2/2 bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra at Saran/ court concerned in Garakha P.S.Case No. 152/2014 after framing of charge with following conditions:- I) One of the bailors will be the close relative of the petitioners.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
