1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Mashrakh P.S. Case No. 542 of 2020, dated 07.10.2020 registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
3. The main submissions advanced by petitioner's counsel are that the so-called victim has been recovered and she has recorded her statement under Section 164 of Cr.P.C. whereby the allegations levelled in the FIR has been falsified by her statement and the petitioner has been languishing in jail since 31.10.2021 and at the time of recording the statement before the Judicial Magistrate the victim revealed her age as twenty years and petitioner is a young person and against him
Patna High Court CR. MISC. No.3448 of 2023(2) dt.02-05-2023 2/2 the investigation has been completed.
4. Learned APP appearing for the State has opposed the prayer for bail.
5. Considering the above submissions and mainly petitioner's custody period, his young age and the facts stated by the so-called victim before the Judicial Magistrate, which are contradictory to the allegations levelled in the FIR and against the petitioner investigation has been completed, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Mashrakh P.S.
