JUSTICE AMARESH KUMAR LAL ORAL ORDER 05-02-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is in custody since 18.09.2014 in a case registered for the offence punishable under Sections 147, 148, 149, 363, 365, 341, 323, 447, 327 and 120(B) of the Indian Penal Code.
The allegation is that the petitioner along with others had taken away the cattle and Ritesh Kumar and Mithun Kumar. It is submitted that there is land dispute between both the parties. The relatives of the informant were grazing the cattle in the field of the petitioner and others. Later on at 5 P.M. both of them were released on the same day.
It is further submitted that the petitioner has no criminal antecedent and later on realizing his mistake, the informant has
Patna High Court Cr.Misc. No.4800 of 2015 (2) dt.05-02-2015 compromised the case and a petition to this effect has been filed before the learned Chief Judicial Magistrate, Bhagalpur, which is annexed as Annexure-3.
Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 89 of 2014, G.R. No. 1017 of 2014 with the following conditions:
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
