The petitioner seeks bail in a case registered under sections 413 and 414 of the Indian Penal Code. The informant apprehended Chandan Singh and Bhushan Kumar Sharma and from their possession stolen motorcycles were recovered.
Learned counsel for the petitioners submits that petitioner is not named in the first information report but on the basis of confessional statement of Chandan Kumar the name of the petitioner figured in the case. It is alleged that one stolen motorcycle bearing registration No. BR-04F-9075 was recovered from the house of the petitioner. It is submitted that from Bhushan Kumar Sharma also one stolen motorcycle was
Patna High Court Cr.Misc. No.4935 of 2015 (2) dt.05-02-2015 2/2 recovered. Pramod Singh and Gaurabh Kumar Singh @ Rana has already been enlarged on bail along with Bhushan Kumar Sharma. On perusal of record it appears that name of the petitioner figured in the confessional statement of Chandan Kumar Singh and from the house of the petitioner one stolen motorcycle bearing Registration No. 6457 was recovered but other accused persons Bhushan Kumar Sharma, Pramod Kumar and Gaurabh Kumar Singh @ Rana have already been enlarged on bail. From possession of Bhushan Kumar stolen motorcycle was recovered. The case of the petitioner stands on same footing. Considering the aforesaid fact, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D. Bharti, Judicial Magistrate Ist Class, Chapra in Khaira P.S. Case No. 113 of 2014. (Prabhat Kumar Jha, J) M.Rahman/- U T
