====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with G. R. Case No.131 of 2021 arising out of Warisnagar P. S. Case No.236 of 2021, instituted for the offences under Sections 341, 323, 354(A), 504, 506 of the Indian Penal Code and Section 37(C) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that petitioner in a drunken state committed obscenity with minor school girls.

The learned counsel for the petitioner submits that petitioner has been falsely implicated. He has not committed any offence.

Patna High Court CR. MISC. No.1637 of 2022(2) dt.04-03-2022 2/2 The learned A.P.P. for the State opposes the bail application and submits that petitioner in a drunken state committed obscenity with minor school girls and as such, the petitioner is a threat.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VI-cum-Special Judge, Samastipur in connection with G. R. Case No.131 of 2021 arising out of Warisnagar P. S. Case No.236 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Nathuni Mahto and in future, if petitioner is implicated in a case of similar nature, the learned Court below shall forthwith cancel his bail bonds if it comes to the notice of learned Court below. The petitioner shall be released after framing of charge.

The application stands allowed.
