The petitioner is languishing in custody since 12.11.2014 in a case registered for the offences punishable under Sections 341, 323, 324 and 326/34 of the Indian Penal Code. Subsequently, section 307 IPC was also added. It is alleged that the petitioner and his wife assaulted the informant, her son and daughter-in-law. Except one injury of the son of the informant all injuries have been found to be simple.

It is submitted by learned counsel for the petitioner that in the background of land dispute the occurrence took place, the accusation of assault is omnibus general and petitioner is also one of the sons of the informant.

No.4673 of 2015 (02) dt.05-02-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Bihia P.S. Case No. 266 of 2014.
