Learned counsel for petitioner submits that in respect of dues of various nature including subsistence allowance, benefit under 7th pay revision commission recommendation and other salary dues, he would be making a representation before the Additional Chief Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna (Respondent no.2). Since the claim is yet to be made before the Respondent no.2, this Court would observe that if the same is filed within four (04) weeks, the Respondent No.2 would be under a legal obligation to take a decision on the same in accordance with law

Patna High Court CWJC No.1052 of 2020(2) dt.13-02-2020 2/2 and pay the financial benefits found due and admissible within a period of three (03) months thereafter. The Authority would also be under a legal obligation to assign reasons by a speaking order in case the petitioner's claim is not admitted by the Respondent no.2.

The writ application stands disposed off.
