JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.12.2014 in a case registered for the offences punishable under Sections 147, 341, 323, 307, 504 of the Indian Penal Code.
The allegation against the petitioner is that he gave back portion of farsa blow on the head of the injured, who is said to have sustained grievous injury on his head. The contention on behalf of the petitioner is that the alleged occurrence is said to have taken place on 07.10.2014 whereas first information report was lodged on 09.10.2014 and no explanation of the aforesaid delay has been given. It is further contended by him that when the injured was examined by the doctor, he found the injury simple in nature but after making

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simari P.S. Case No. 181 of 2014.
