The petitioner has preferred this application for grant of regular bail in connection with a case registered under sections 8, 20(b)(ii)(B), 22, 23, and 29 of the NDPS Act. As per allegation in the FIR, 8.560 kgs. of ganja was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 8.10.2020 and has no criminal antecedent. Heard learned APP for the State.

As per the report contained in letter dated 3.8.2021

Patna High Court CR. MISC. No.11879 of 2021(3) dt.17-08-2021 2/2 received from the Superintendent of Police, Kishanganj, the petitioner has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Kochadhaman P.S. Case no. 246/2020 (giving rise to Special Case no. 12/2020) on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge - cum- Special Court, NDPS, Kishanganj.
