This application for anticipatory bail arises out of Raniganj P.S. Case No. 283 of 2015 for the offence under Sections 409 and 420 of the Indian Penal Code. The petitioner, at the relevant point of time, was working as a Junior Engineer and it is stated that he was assisting the Local Self Government in executing certain works under B.R.G.F. Scheme for the financial year 2011-12 to 201314. There is allegation of irregularities committed in execution of the projects under the said scheme.
Learned counsel appearing on behalf of the petitioner has submitted that the main accused, i.e. Mukhiya and Panchayat Secretary of the concerned Panchayat, have been granted anticipatory bail by this Court by orders dated 05.08.2016 passed in Cr. Misc. No. 20012 of 2016 and other
Patna High Court Cr.Misc. No.4793 of 2019(2) dt.29-01-2019 2/2 analogous cases, 14.09.2016 passed in Cr. Misc. No. 30262 of 2016, 24.11.2016 passed in Cr. Misc. No. 45654 of 2016 and another co-accused, namely, Amal Kumar Dey, has been recently granted anticipatory bail by this Court by order dated 23.01.2019 passed in Cr. Misc. No. 79493 of 2018. Considering the aforesaid submission that similarly situated co-accused persons have been granted anticipatory bail, this application is allowed.
Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in Raniganj P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
