The petitioner seeks bail in a case registered under section 395 of the Indian Penal Code The first information report is against unknown. Learned counsel for the petitioners submits that the name of the petitioner figured in the case in paragraph 68 of the case diary in the confessional statement of Brij Rai. Similarly situated co-accused Sitaram Rai has already been enlarged on bail vide Cr. Misc. No. 1110 of 2015.

Considering the fact that petitioner is not named in the first information report but he was arrested on the basis of confessional statement of co-accused and he is in jail

Patna High Court Cr.Misc. No.5062 of 2015 (2) dt.05-02-2015 2/2 since 20.11.2014 but he has not been put on T.I.P. the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in Shyampur Bhataha P.S.
