JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Petitioner is languishing in custody since 16.08.2014 in a case registered for the offences punishable under Sections 153(A), 295(A), 447, 504, 506 read with Section 34 of the I.P.C and Section 11(G) of Prevention of Cruelty to Animals Act.

It is alleged by the informant that petitioner, Nasrul Haque and Sk. Kasim were slaughtered a red colour calf and when the informant made protest then the accused persons gave life threatening.

It is submitted by learned counsel for the petitioner that co-accused Shahnaz Begum being mother-inlaw of the petitioner purchased ten dhurs of land of the informant's family and subsequently she occupied more than the purchased area for which there was enmity between the informant and the petitioner. It is further submitted that

Patna High Court Cr.Misc. No.4960 of 2015 (2) dt.05-02-2015 2/2 Shahnaz Begum has been granted bail vide Cr. Misc. No. 917 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Dhaka P.S. Case No. 75 of 2014.
