2. The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with K. Nagar P.S. Case No. 350 of 2020 registered for the offences punishable under Sections 420, 379, 419, 387, 385, 384 of IPC and later on charge-sheet submitted under Section 341, 387, 419, 420, 504, 506 of IPC.

3. The allegation against petitioner is to cheat informant who was working with petrol pump for Rs. 3049.57 against 35.89 litre of petrol, where allegation is to present the vehicle as same is of Block Development Officer, K. Nagar, Purnia.

4. It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner was given benefit of

Patna High Court CR. MISC. No.1569 of 2025(2) dt.05-02-2025 2/2 Section 41 (A) of Cr.P.C. during investigations and he never found to misuse it. It is pointed out that after submitting the charge-sheet the learned trial court took cognizance against this petitioner for the alleged offences.

5. Learned APP, opposed the prayer of bail.

In view of aforesaid facts and circumstances and by taking further note of nature of accusations and also as petitioner was given benefit of Section 41 (A) of Cr.P.C. during investigation, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia/concerned Court, where the case is pending in connection with K. Nagar P.S. Case No. 350 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
