The petitioner seeks bail in connection with Chakiya P.S. Case No.339 of 2013 registered for the offences punishable under sections 379 and 411 of the Indian Penal Code as well as sections 7 of the Essential Commodities Act.
The prayer for bail of the petitioner was earlier rejected by this Court on 4.6.2013 in Cr. Misc. No.18629 of 2014. It has been contended that the petitioner is in custody since 30th November, 2013 and two other accused persons, namely, Bimal Kant Rai and Jitu Lal Prasad having more or less identical allegation have already been granted bail by different
Patna High Court Cr.Misc. No.7096 of 2015 (2) dt.18-03-2015 2/2 orders passed by different Benches of this Court.. Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakiya P.S. Case No.339 of 2013.
