Petitioner is languishing in custody since 20.10.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The motorcycle of the informant was robbed which was subsequently recovered in an abandoned condition. The name of the petitioner sprang up on the confessional statement of co-accused Anil Kumar Mahto. It is submitted by the learned counsel for the petitioner that the petitioner has not been put on T.I.P. till date and the co-accused Anil Kumar Mahto on whose confessional statement the name of the petitioner has been surfaced has been granted bail vide Cr. Misc. No. 42573 of 2014. Considering the aforesaid facts, let the above

Patna High Court Cr.Misc. No.5373 of 2015 (4) dt.10-02-2015 named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 535 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
