The petitioner is apprehending his arrest in connection with G.R.No.905 of 2018 (arising out of Jamalpur P.S.Case no.95/18 dated 54.6.2018) registered for offences punishable under Sections 25(1-B)a/26 of the Arms Act.

Allegation against the petitioner is about recovery of 01 pistol, 03 magazines,47 live cartridges and 04 used cartridges from the house of the co-accused Jugnu Mandal. The petitioner and Jugnu Mandal succeeded in fleeing away and it further appears that the petitioner is accused in two other cases. Submission of the learned counsel for the petitioner is that there is no signature of the independent witnesses on the seizure list and he has been falsely implicated in this case. Heard learned A.P.P. also.

No.5401 of 2019(2) dt.31-01-2019 2/2 Having heard both sides and in view of allegation as well as the criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
