JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-02-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seek bail in a case registered for the offence punishable under Sections 342, 323, 324, 366A, 368, 373, 376/34 of the Indian Penal Code.
It is submitted that the petitioners are not named in the FIR. During investigation, it has only been suspected that since the named accused are the sons of the petitioners, they might have role to play in the offence. It is further submitted that the victim has been examined under Section 164 Cr.P.C. and no allegation has been made against the petitioners. They are in custody since 30.03.2014 having no criminal antecedents.
Patna High Court Cr.Misc. No.6078 of 2015 (2) dt.13-02-2015 2/2 Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Buxar in Nawanagar (Sonbarsa) P.S. Case NO. 233/2013 (Posco Trial No.03/2014) with the following conditions : 1.
One of the bailors will be the close relative of the petitioners.
2.
The petitioners will not indulge in similar or in any other offence.
3.
The petitioners will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
