The petitioner is languishing in custody since 07.10.2014 in a case registered for the offences punishable under Sections 366A and 120B/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim got her age recorded as 18 years when the court has assessed as 17 years where she stated that she was being taken forcibly be Manish Singh and in the car the brother-in-law of Manish was also present. The vehicle was being driven by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner is a taxi driver and the vehicle was
Patna High Court Cr.Misc. No.5106 of 2015 (02) dt.06-02-2015 2/2 hired by the accused persons. The victim has not alleged any misbehaviour by this petitioner.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, District - Samastipur in connection with Rosera P.S. Case No. 302 of 2014.
