The petitioner is languishing in custody since 26.11.2018 in a case registered for the offences punishable under Section 30(c) of the Bihar Prohibition and Excise Act, 2016 . The prosecution case is to the effect that the petitioner was apprehended for abducting a child, upon which information was given to the police. It is alleged that when the police took him under custody, he was found in inebriated condition, as a result, apart from the case for the offence of abduction, the present case has been lodged against the petitioner.

It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been made accused in this case. A statement has been made in paragraph

Patna High Court Cr.Misc. No.2214 of 2019(2) dt.17-01-2019 2/2 no.3 of the petition that the petitioner is also involved in one other case, wherein he is on bail.

Learned APP submits that the petitioner was found in intoxicated condition.

Considering the nature of accusation and the period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Bettiah, West Champaran in connection with Bagaha (Bhairoganj) P.S.
