The petitioner apprehends his arrest in connection with Chanpatiya P.S. Case No. 148 of 2019 registered for the offences under Sections 147, 148, 149, 341, 323, 302 and 307 of the Indian Penal Code.
As per the first information report, the petitioner is one of the assailants of the deceased.
Learned counsel for the informant has produced before me a copy of the order dated 08.10.2020 passed in Cr. Misc. No. 12176 of 2020 by which anticipatory bail petition of co-accused Nandlal Mahato having similar allegation has been rejected considering the injuries sustained by the deceased. Considering the above facts, I am not inclined to grant
Patna High Court CR. MISC. No.95 of 2020(3) dt.26-10-2021 2/2 the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is hereby rejected.
In case the petitioner surrenders and prays for regular bail before the court below within a period of four weeks from today, the court below will consider the petition for regular bail of the petitioner without being prejudiced by the fact that anticipatory bail petition has been rejected by this Court.
