The petitioner seeks bail in connection with Amarpur PS case no. 34/2015 registered for the offences punishable under Section 366A/34 of the Indian Penal Code.

Allegedly, Safia Parween @ Khooshboo, the daughter-in-law of the informant became traceless with her two years child and on enquiry the informant came to know that the petitioner and his associates have kidnapped her and further the petitioner who told the son of the

Submission is of false implication and that the petitioner has been implicated due to dirty village politics, no one has seen the petitioner kidnapping the victim girl, first information report has been lodged after much delay, besides the suspicion there is nothing against the petitioner and he is suffering in custody since 18.02.2016. Learned A.P.P. opposes the prayer and submits that the victims are still traceless. In the facts and circumstances stated above considering that charge-sheet has already been submitted and there is no chance of tampering with prosecution evidence, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction Chief Judicial Magistrate, Banka arising out of Amarpur PS case no. 34/2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial

Patna High Court Cr.Misc.
