The petitioner seeks bail in Cheriya Bariyarpur P.S. Case No. 48 of 2014 registered under section 307 and other allied sections of the Indian Penal Code and 17 C.L.A. Act. The petitioner is not named in the first information report.

Learned counsel for the petitioner submits that the name of the petitioner figured in the confessional statement of co-accused persons. Except the confessional statement no material was collected to show the involvement of the petitioner. The learned A.P.P. also submits that the petitioner was found having talk with other accused persons. Of

Patna High Court Cr.Misc. No.5487 of 2015 (2) dt.10-02-2015 2/2 course it appears that the petitioner has got criminal antecedent but except the confessional statement of co-accused no tangible material has been collected. Other accused Nawab Sahni Khushi Lal Mahto and others have been granted bail.

Considering the facts and circumstances of the case the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Begusarai in Cheriya Bariyarpur P.S.
