The petitioner seeks bail in Majorganj P.S. Case No. 325 of 2014 registered under section 392 of the Indian Penal Code.
The informant alleged that while he was going along with his sister on motorcycle the petitioner along with Chandan and Manish intercepted him. Manish pointed out pistol and the petitioner is alleged to have snatched Rs. 7000/- and on Samsung mobile. Mobile was recovered from the possession of the petitioner.
Learned counsel for the petitioner submits that Manish has already been granted bail by learned 3rd Additional Sessions Judge, Sitamarhi vide order passed in B.P. No. 1309 of
Patna High Court Cr.Misc. No.5491 of 2015 (2) dt.10-02-2015 2/2 2014. The sister of the informant was accompanying him but the police did not record her statement. The petitioner is on inimical term with the informant. It appears on perusal of the record that the informant identified the petitioner and two other accused. There is specific allegation against the petitioner that he snatched Rs. 7000/- and one Samsun Mobile from the possession of the petitioner. The informant was robbed in broad day light. Petitioner has got criminal antecedent and two criminal cases are pending against him.
Considering the aforesaid fact I am not inclined to enlarge the petitioner on bail. The same is rejected. The petitioner may renew his payer for bail after remaining one year in custody.
