The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code and sections 30(a)/36/41(i) of the Bihar Prohibition and Excise Act, 2016. Total 1146.930 litres of foreign liquor has been recovered from a truck.

It is submitted that petitioner has falsely been implicated in this case. Name of petitioner transpired in this case on the basis of confessional statement of driver Uday Singh @ Kallu which was apprehended by the police. Nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1st-cum-Additional Sessions Judge, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 102 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
